SEATTLE -- An Auburn man is accused of repeatedly raping a deaf woman inside her home.

Nicolas B. Masuhay, 62, has been charged with two counts of third-degree rape for incidents that took place between March 2009 and May 2009, according to prosecutors.

Investigators believe Masuhay raped the 40-year-old victim, an acquaintance through the family, several times over the two-month period. Prosecutors believe Masuhay was fully aware of the conditions of the victim, who is "almost completely deaf and has difficulty seeing," according to detectives.

The man first forced himself on the victim March 19 while she was reading the Bible in her room, according to the statement of probable cause.

Masuhay walked in and "asked if she had any money and then started talking about sex," investigators said. The woman, who uses a hearing aid and is able to read lips, told him to leave her alone, but Masuhay pushed her onto the bed, according to the document.

The victim "started yelling for him to get off and that she didn't want to have sex," but Masuhay ignored her pleas and cries of pain, the statement said.

Detectives said the victim "could not stop Masuhay no matter how much she tried, and she was not strong enough to push him away."

During the two-month period, Masuhay raped her six or seven times, investigators said, even causing her to get physically ill after one incident. He told her "he would be back for more and she better not tell anyone," the document said.

According to detectives, the victim's sister helped the woman file a police report in July 2009 after learning about the alleged rape.

When interviewed by investigators, Masuhay said "he would not need to have sex with (the victim) because he is married," and "laughed at the allegations," the statement said. However, he did not have an explanation as to why the victim would make up a story.

Prosecutors have requested $150,000 bail for Masuhay, who they believe was fully aware of the victim's condition. Masuhay is being held at the Norm Maleng Regional Justice Center.
