Judge Rules Against Nude Club In Fight Over Federal Way Ordinance

KING COUNTY - The Deja Vu nude dance club in Federal Way has lost another round in its court fight against the city's adult-entertainment ordinance.

U.S. District Judge Marsha Pechman has issued a ruling in which she agrees with city legal officials that the ordinance does not violate the club owners' constitutional rights.

Deja Vu's attorney, Jack Burns, says he will now appeal to the 9th U.S. Circuit Court of Appeals. But the club faces an August 13th deadline to either close or move to an area of the city that permits adult entertainment businesses.

Burns says he will ask the court to prevent the city from enforcing the ordinance until the case is resolved.

Federal Way's 1999 ordinance requires all adult businesses to locate within community business zones. The only areas with that designation are in the city's south end. Deja Vu is in the downtown area.
