SEATTLE - Some people skip dessert; others eat it first.

But we found a dessert that requires a signed waiver before you partake.

Step into the 5 Spot on Queen Anne, and you realize immediately it's not your average cafe.

But these days, you can gain a pound just be reading about their newest dessert -- a banana, battered, rolled in sugar, deep fried, served with ice cream, whipped cream, and macadamia nuts.

It's appropriately called "The Bulge."

5 Spot co-owner Jeremy Hardy says the sinful surprise has a definite purpose.

"It was created to make a statement about frivolous lawsuits and accountability."

The Bulge is the 5 Spot's response to recent lawsuits where restaurants are sued over customers fat intake.

"It's just, just absurd," says Hardy.

And to illustrate his point, all who order the Bulge must sign a waiver.

"Nobody gets it without a waiver, no exceptions."

It's the real deal -- and is designed to stand up in court:

"I, release the 5 Spot from all liability of any weight gain that may result from ordering and devouring this sinfully fattening treat."

It goes on to release the 5 Spot in the event eating the Bulge causes love handles, saddlebags, or junk in the trunk.

Despite the waiver, Hardy says he sells between 40 and 50 a day. He hopes all who partake are getting the real point.

"People are accountable and responsible for their own choices and decisions," he said.
