AARP Upset Over I-330 Phone Message

KING COUNTY - On Tuesday, you'll be asked to vote on the hotly contested health care initiatives I-330 and I-336.

The AARP isn't too happy, and says I-330 is trying to use their good name to get votes.

AARP says an I-330 telemarketing campaign is dial 'M' for misleading. Bob Fithian couldn't believe his ears. He's one of thousands of Washington seniors who got the same call.

"This is just down right sleazy and misleading," says Fithian.

On the other end? An AARP member asking seniors to vote 'yes' on I-330.

That surprised Fithian -- he's an active AARP member and knew the organization is against I-330.

That's putting it mildly. AARP is so opposed to 330, they even puts their name on the Vote No on I-330 political ads.

To make matters worse, Fithain learned the campaign call is linked to the I-330 campaign and its outspoken backer, the Washington State Medical Association.

Fithian, a retired doctor is also a member of the medical association.

"It made me angry, cause it's been so misleading and not in the public's interest," says Fithian.

But Tom Curry, executive director of the Washington State Medical Association, counters: "I call it clear, concise and totally not misleading."

Curry insists the ads are legal and not an attempt to use AARP's good name to get votes. He says 600,000 seniors got the call.

He gave KOMO 4 News a transcript of the call. Here's part of it: The caller says he's "...a long time member of AARP and senior active in healthcare issues... Voting 'yes' on I-330 and 'no' on I-336 will help doctors be there for us..."

"It's never been my understanding that by joining AARP, you signed away your individual rights to free speech," says Curry.

Try telling that to the AARP. They've been getting repeated calls from members, half confused, the other half ticked off.

"They're hearing from an AARP member who says vote 'yes' on 330. What's confusing is they think the organization as a whole is saying vote yes, which is untrue," says Jason Erskine, AARP's Washington State Director.

The campaign caller is actually an AARP member. He's Frank Jenkins of Tacoma.

The 84-year-old told KOMO 4 News he may be an AARP member, but the AARP says he doesn't have the right to use their trademark and if they don't stop, they're threatening a lawsuit.

In the meantime, the AARP sent the Medical Association a cease and desist letter.

The medical association told us it's a moot point since all the calls have already been made.
