Accused child rapist wants to show tapes to victims

TACOMA, Wash. -- The man accused of raping young boys and videotaping the incidents says he wants to show the videotapes to the victims.
Investigators say Marc Gilbert enticed young boys to his home in Lake Tapps where they played sex games while he recorded them.
Gilbert, now on trial, is acting as his own attorney. On Monday, he told a judge he wants to interview his alleged victims and show the victims the video footage he took. A standby attorney would do the actual interview.
"Our intention to show the videos during the pre-trial interviews is in no way an attempt to harass or embarrass these poor people involved in this thing," he said.
Gilbert's case gained notoriety when KOMO News first reported on a strange quirk in the law that allowed Gilbert to watch the videos of the alleged abuse while sitting behind bars.
He has already pleaded guilty in federal court to sex crimes and received a 25-year prison sentence.
He is now facing charges in Pierce County that could lead to more prison time.
At least one of his alleged victims said he is ready to testify.

I think through a strange quirk in the system, we should blind and castrate this man.
It's not a "strange quirk in the law" that allowed this man to view the tapes. It's called his Constitutional right to examine evidence being used against him. I know you guys write news, but don't you have anyone with a law degree on your staff? There was never any question that he would be able to view the tapes...

More proof that these sickos care nothing, absolutely nothing for their victims. I think the law should totally change for these kinds of criminals - we have proof of his crimes - now, let's just shove him into a meat grinder without pain killers and be done with him.
On WHAT basis, pray tell, would the judge agree to do such a thing? This guy obviously thinks his victims loved him, or wanted his sickness, or enjoyed him....Why does the article not explain his reasons for showing the tapes to the victims, except to show them at trial, but for what purpose? Come on Komo, Ask the question, what will readers want to know?  5 basic points to every piece, who, what, WHY, where, when. Readers always want to know WHY. Give us the why. to introduce at trial for___________ (fill in the blank).
Gilbert is already serving a 25 year federal sentence for these crimes, which would have him back on the streets when he's in his 70s. He probably doesn't want the to be tried again by the State of WA because a 2nd sentence could mean he'll never see the light of day again. I bet this is a ploy to get the State to drop the trial or make some sort of mistake in his favor.
What is wrong with this country that we allow child molesters to victimize their victims all over again and get their jolly's while doing it? Do you think someone should change the laws just a bit? Between that and abortion being legal for the whole 9 mos. for whatever reason in some states just makes me sick. Children aren't protected at any age! Weren't we supposed to be "one Nation under God" at one point??
Just looking at this guy's picture makes my skin crawl. Throw him in general population in the prison and *someone* will take care of him.

I am willing to bet that the Founding Fathers would say that if one was videotaping himself in the act of committing a crime that individual would not be granted the same due process that others accused of a crime were. While I am all for the rights given in the constitution, videotaping yourself doing something this perverse should be an automatic exclusion from society by whatever means necessary. Unfortunately the existing justice system was constructed because of the previous systems view of "guilty until proven otherwise - and you will confess" as justice.
He's making a mockery of the justice system. Just as the t Colo. shooter will do. when there is much evidence we should have an express lane. I know do process but really? Years go by.They have tapes of the crime that he made. Â

I cannot believe that they filed the motion forcing victims to view their own rapes. One would think that this would fall under the heading of RCW 18.235.130 -Unprofessional conduct, at the very least. By forcing the victims to view the tapes, it is an extended form of sexual assault by Gilbert for which the defernse counsels should be held accountable and disciplinary action sought.

Defending a client who's innocence can be verified with DNA and other forensics is one thing but to defend a man who took films of himself raping children and has a history of sex acts against children is unthinkable.

The defense attorneys are every bit as guilty as their client when they continue to waste the courts time and suck taxpayer dollars for years on end. I understood that the courts have a case schedule to follow - 180 days from summons to ruling. Why in Hell has this gone on for years??

This case began in 2007 - Weldon Marc Gilbert has wasted YEARS of taxpayer dollars. He knows that he's going to prison so this is just showboating: The filthy SOB wants a new avenue of perverted pleasure - forcing his victims to watch what he did to them under the guise of an interview. His defense attorneys must be real slimeballs to go along with this sickening convolution of law by filing the motion on behalf of their client.  He's got 13 counts against him, including child rape and molestation and now he wants to get his thrills watching his victims watching themselves being raped by him. WTF?!?!?!?.
Any judge allowing this should be removed from the bench. What about VICTIM'S RIGHTS, Judge?

Sure, let him interview the victims - just provide the victim with a magnum, stick them in a soundproof room and wait for the victim to come out. Â Then send in the hazmat team to clean up the room.
the judge earlier ruled wrongly that he could view the tapes as he was acting as his own attorney. Â Under the law, defense attorneys are allowed to review material tied to the case. it does not say the defendant can review any evidence just his/her attorney. as i said when this first came out he has no right to view this material as he knows what is on the tapes as he made them. there is no reason to show the tapes in court and just have the arresting officers who saw the tapes say in court if they saw the defendant raping his victims on tape. To show the tapes in court would be admission of guilt and no questions addressed to the victims would be needed to convict the defendant of the crime.
Is a trial even necessary?

I'd love to see one of the victims in this case WISELY spend fifty cents (right between this sicko's eyes), plead insanity and get some justice. The loopholes this idiot is using need to be CLOSED, and the judge should absolutely DENY this guy any chance at tormenting the victims AGAIN. It's all a control game to this guy. He already knows he's going down, so why not get in a final dig? Put this P.O.S.down like a dog.

I had someone like this in my life for 20 years of my life. oh, yeah, he represented himself and got to interview me and we had a restraining order that he found ways to get past, years of harassment; following me just outside the distance specified in retraining order, calling my friends and family members pretending to be someone else to get info on me. This was back in the 80s and 90s. It started when I was 13 till I was in my 30s. It took years till he was finally caught and arrested for molesting some little girls in 1997 and was put in "mental" prison. He has access to the internet! This story brings back some pretty bad memories. Its the justice system that is so flawed, tormenting these victims the most. The law just lets these guys "have their day in court", what about the victims?? What about THEIR freaking day in court??!! Guys like this absolutely do NOT think what they do is wrong! They see it as normal in some part of their brains! My heart is pounding so hard right now with anger about this story, I can't even believe this is still going on!!!

@32jim2 I think out of principal he shouldn't be able to view the videos. It absolutely boils my blood that he has access to them. Its bad enough that he may be granted access to question the victims. Can you imagine how that must feel for those victims? I can't even imagine...
