Accused dog killer has new puppy at home, despite judge's ruling

EAGLE CREEK, Ore. -- A man who admitted to police that he killed his dogs because he couldn’t afford to take care of them now has a puppy at home – despite a judge’s order against it.
Japheth (J.P.) Daniel Stalcup, 25, is awaiting trial on aggravated animal abuse charges in connection to the November alleged killings of his two dogs. As part of his conditions to be free from jail is the order of “no possession or living with any animals.”
Acting on a tip from a viewer that Stalcup had a puppy, KATU visited his home in Eagle Creek, Ore., on Monday. We talked to Stalcup’s wife, Rose Stalcup. She admitted they had the puppy, but said it was OK. She also said the couple had the puppy before the judge's ruling.
“It’s legal. We’ve already looked into it,” she said, then ordering KATU to leave the property.
Reached by telephone, J.P. Stalcup also said his lawyer cleared it with a judge to have pets at home. However, prosecutors said the defendant is not allowed to be in a home with animals.
Attempts to reach Stalcup’s attorney on Monday were not successful.
It is standard for defendants awaiting trial on animal abuse charges to not have contact with animals.
The investigation of Stalcup, 25, began when he initially told police his dogs had gone missing and that he later found Buddy and Duke dead about 100 yards from the house. Both dogs had been killed with an axe.
Stalcup gave an interview to KATU in November, decrying the disturbing nature of the dog slayings.
“What happens if, you know, they do that a couple more times and all of the sudden they’re not happy with – it’s not giving them as much jollies as it was the first couple times – so what are they gonna do next?,” Stalcup said in November.
As the police investigation progressed, he eventually admitted to killing the dogs with an axe because he couldn’t think of an alternative to caring for them.
He is due in court on March 25.

@Elaine2: Uh, did you READ this article? The Judge said NO PETS. Yet this guy and his enabling wife went and got one anyway. So it seems to me your wrath against the Judge is very misplaced. The perp said his lawyer cleared it with the Judge but it seems no one can confirm this.
@usnrbb - yes, I read the article. It sounded to me when I read it that this judge allowed it. It is KOMO after all. They may have changed it after I made my comments. :)
That is crazy, how sick and twisted are these people. I'm surprised they are allowed to have children, her tubes should be tied. He said it himself, "what happens if they do that a couple more times and its not giving them as much jollies it did before, whats next?" Hopefully he doesn't kill this pup with a hatchet to get rid of it and not get in trouble for owning it. I can see it now, "I killed it with a hatchet because you guys said I couldn't have it." Apart from the issue of the horrible animal cruelty, I see deeper and darker issues. When is he going to progress to humans?
That makes me sick. I cannot believe how cruel some people are, and how blind "justice" really is. You can't afford your pets so you kill them with an axe, and yet you have ANOTHER dog in the house? That is ridiculous. Hopefully the puppy is removed before it becomes too old to be cute and is slaughtered like the previous dogs.
Not really sure we have laws when the ones suppose to be inforcing them do not. Goes back to that loophole comment I made the other day. Be proactive and close the loopholes before these POS's reoffend.Animal welfare needs to step in and remove that dog.

Okay, so he violated the terms. So why hasn't his ass been thrown back in jail? Funny he killed his other 2 'cause he couldn't care for them. So how is it any different with this one?

I look at that happy dog face and it saddens me to think this poor dog has no choice in the matter as to the sicko his owner is and his wimp of a wife. So very sad. I mean, what's to keep him from killing it too?? HOW could this be OK with the law? They need to take this poor unsuspecting dog away immediately.

@Harley-H.S.C. How about being preemtive. Like a little kidnapping? I'll be glad to provide a foster home. Of course that would involve crossing state lines which makes kidnapping a Federal crime ... but, does that apply to dogs? In any case. I can find a place for him.

Arrest him. Â Seems pretty simple, no? Â A lot could happen between now and March 25, especially since the dog is running loose. Â Arrest him, make an example of him because he's in violation of his terms, and get the dog to a safe home.
