Mayoral recall effort picks up steam in city of Pacific
PACIFIC, Wash. -- Fed up with what they see as a litany of offenses, on Thursday a group of Pacific residents filed an official complaint to recall Mayor Cy Sun.
The small town has made big headlines this year, and it's all thanks to the growing tension between city workers, residents and the mayor.
Since taking office in January, Sun has been a lightning rod for controversy. He was arrested by his own police force in July when he tried to enter the city clerk's office. The arrest capped months of long-simmering tensions between Sun, members of the city council and Sun's opponents who accuse him of abusing power in the small town on the King-Pierce county line.
Prior to the arrest, Sun has locked the city clerk out of her office, fired three heads of department and caused two more to quit. In response, the city council took a vote of no confidence against Sun.
On Thursday, Donald Thomson, who chairs the Committee to Recall Cy Sun, signed the complaint to initiate the recall of the mayor.
For his part, Sun was unfazed by the move.
"It's a free country," he said. "They can do anything they want."
Thomson's committee prepared a 200-page book documenting Sun's alleged wrongdoing.
"He won't follow procedures. He won't follow the law. He's stripped the city of all of our management," Thomson said.
If he's concerned about the documents, Sun wasn't showing it on Thursday.
"200 pages?" he said. "Maybe they should go to 500 pages."
Sun said some people in the city just don't understand that he's trying to make Pacific a better place and make sure it's prepared for a future economic downturn.
"It's a real threat that's facing us right now," he said.
But those working hard to recall him claim he's made things in the city far worse. They say he tried to influence a criminal investigation, and Sun even admits he destroyed public records.
"Our city's 100 years old, it's worth saving," Thomson said. "We have to save it."
A judge will ultimately decide if the complaint can move forward. If so, the committee will have to collect the required number of signatures to move it to a special election.

Here are some facts that are more current: Pacific Public Safety Director John Calkins was charged with drunk driving and intimidating the arresting officer; he testified in court that he doesnât drink beer, while I have seen a photograph of him doing just that; he is accused in a deposition of requiring employees to view porn; he also failed a polygraph examination on whether he threatened an individual with a hand gun, and he was investigated for tampering with a witness. He proposed writing more speeding tickets not for public safety, but to raise revenue. His department practiced racial profiling. When a house burned to the ground on his watch, he bellowed at a city council member for asking why. When I published the claim that he was related to then-Mayor Howard Erickson, he bellowed at me in a city council meeting, denying the allegation. But according to the people who disclosed the relationship, it was Mr. Erickson who made them aware of it. No-one ever hauled him up short for this and other rude behavior until Mr. Sun put him on administrative leave for bellowing at the cityâs treasurer about a month ago. By the way, Mr. Calkins testified in court under oath that he canât raise his voice, so he couldnât have yelled at the arresting officer at his DUI stop. Or at me, either. I must have imagined it.
The next council meeting will be video taped and you'll have no idea who is doing it. As this is legal in Washington state as the meeting is a public forum.
So bullies beware. You violate the ADA act or commit acts of harassment you will be on camera. As we know the Pacific police are not honorable and actually encourage this type of behavior at our mayor; all footage, along with names of what will soon be defendants in civil and/or criminal investigations will be given to the King County Sheriff's office for investigation. If that doesn't get results, then copies of footage will be given to the Department of Justice for investigation.
The council can't expect civil meetings and then ignore and participate in civil unrest simply because it is directed at our Mayor whom the council has never had the professionalism to accept simply because he was a write in candidate.
The fact our Mayor was a write in candidate who WON speaks volumes to the people of Pacific's disappointment, distrust, and plain old being feed up with the city government and city employees - including the police department.
So, have your meetings, behave yourself, and act like adults and SMILE fro the camera..

I had a few questions for 711 cares. I have been reading what you have been writing on this site and a few questions come to mind. Perhaps you would answer a few of those questions for me. Were you present when the Mayor was served with the charges against him? I ask this because the prosecutor's office would probably be interested if you witnessed their server preforming their duties in a threatening way. I am sure you are aware that the prosecutor's office is running the show now that the statement of charges have been filed.Â

I would also like to know, what missing money are you speaking of? I believe that the State Auditor's office does regular inspections of the city's books. In fact, I believe that I read in the statement of charges a letter written by the council president asking for his office's help. I wonder why would they do that if they were hiding something?

Then there is your mention of violation of ADA laws. Now I am disabled so I do know a thing or two about this. You may want to call the Department of Justice. They will tell you that no one can force ADA accommodations on another person. Our medical conditions are private and that information is protected. It is up to the person with a disability to ask for those accommodations. And they are to be reasonable. I read that the vote that was taken allowing the Mayor to choose who ran the meeting was split and the council then followed the council rules that were set forth long before they were the council. Why would you post something misleading or untrue?

If you are aware of threats against the Mayor, have you done your part to notify the authorities? I understand there is some turmoil between the Mayor and the police force, but if I had knowledge of threats against another human being I would find some law enforcement body to report that to. I would feel that was my duty. What are you asking the people with military experience to do? Do you want them to take up arms? Surely you are not asking anyone to break the law or endanger anyone's safety. Using the Mayor's military experience as a defense of any possible wrong doing is an insult to those that serve their country honorably and then continue to conduct their lives in a honorable way. Thank you to Mayor Sun for your years of military service. Thank you to all those that serve and defend this great country of ours. Please, 711 cares, if you truly care, be more careful with your words. Especially in reference to our soldiers, past, present and future.

Finally, are you aware of what a red herring is? I am guessing you do because you employ that often. It is the use of another topic to divert attention away from the true topic, problem or issue. If there are valid reasons that the Mayor should not be recalled, post those. I would love to see any proof of any of those claims. It seems to me that the Recall efforts has done some homework. I implore you to do the same. Are you opposed to citizens exercising their rights with regard to the recall effort?

 @dad24 There is no legitimate question of our mayor being a US Citizen, however that hasn't 't stopped the bully party from ridiculously demanding a copy of our mayor's birth certificate. to which they are not entitled. Ignore bullies and they lose power.   You ask a lot of questions to which you would have answers if you read my post on the other KOMO sites regarding our mayor. However, as is my right, I will answer those questions which I deem deserving.Â

 Are you against the mayor exercising his constitutional right to defend himself against a recall effort? Sure sounds like you are. It also sounds like you do not believe in innocent until proven guilty. Our mayor has not been proven guilty of anything other than keeping his campaign promise to clean the dirty city hall house of Pacific.
. I am also keenly aware of the recall process and the prosecutor's part in it. As such there was no reason to practically throw this literal book of nonsense at our mayor as it was intended as nothing more than a childish act of bullying. It was not served at the prosecutors request and not even served. It was simply a copy tossed as our mayor which doesn't intimidate him one bit. . If and when the prosecutors office determines there is any reason to provide the mayor with this document the prosecutor will have it done in a professional and legal manner. That has not happened.

As for the ADA act, I am familiar with that as well. And it was violated. Your twisting to make it sound like ADA can't be forced is a red herring. As you know the mayor asked for help, explained why he needed it - a war time disability - and he was DENIED.

I am sickened at the behavior of Mayor Sun's opponents. They are desperate, inhumane fools. Obviously, they are not confident of their recall campaign and they know they can't push Mayor Sun to resign. So they have taken up the tactics of bullying, harassing, and outright cruelty. At last night's (August 27th) council meeting they practically threw their ridiculous recall charges, in the form of a book, at Mayor Cy. The recall weirdos pack the council chambers well in advance so no one else can get in and then they play it up for the media.
However last night even the media was disgusted with the inhumane and brutal treatment of a fellow human being and Mayor Sun.
Mayor has no fear of this recall attempt because he knows they will lose and when all the information comes out about the missing money stolen from Pacific taxpayers crap will hit the roof. THAT is why the council, the police, and others are trying to silence Mayor Sun and keep him from accessing anymore city record.. It would seriously NOT surprise me if Mayor Sun were to have a so called accident and die. That is how much money and jobs and political positions that are at stake .Â
I call on all members of the military (current and past) to do something - even if it's just voicing outrage over the treatment of fellow war hero Mayor Cy Sun. Last night, Mayor Sun (who is not required to chair the council's meeting) was having trouble with painful ringing in his ear and he is deaf in his left ear as a result of battle. Remember Mayor has two purple hearts and various other medals, shrapnel throughout his body, a severe concussion that resulted in his left ear deafness, lost a kidney, and has a bullet in his back that has been there for over 60 years ALL from serving his country.
Yet, when the Mayor made a motion to turn over chairing the meeting to the mayor pro tem as Mayor had put in a 12 hour day and was suffering pain and ringing in his ear. Not only did the entire council - including former vietnam vet and convicted murderer council member Gary Hulsey - the entire council voted unanimously to try to force the mayor to chair the meeting anyway. They mocked the mayor's inability to hear saying "oh he can't hear he's just an idiot." They called him names. Finally, the Mayor walked out. Reva Bryant a former school district employee was one of the loudest and most horrific of the bunch. Shame on you Reva. Have you no decency? As for Pastor Tyree while you were not in attendance at this cruel mockery - you are part of the recall which you have every right to be - however you are also a servant of God and as such you have a duty to do what you can to bring God's peace to such horrendous action. Especially considering you are pictured in numerous media photos walking step in step with the murdering councilmember Gary Hulsey and Reva and all the others. I am ashamed of all of you.
Last night was also a violation of the American with Disabilities Act as the Mayor - like any other US citizen is entitled by law to reasonable accomodation for his (WAR SERVICE) disability. Not only did the council and therefor the city of pacific fail under this act. They have now made the entire city liable for tort damages, civil penalties, and punitive damages should the mayor decide to sue.
 @711 Cares I fear for the mayor's safety as well. I'm glad he has combat experience in case someone tries to hurt him. The part about this whole situation that amazes me is that there is a group of people trying to save the jobs of a bunch of overpaid, no good, insubordinate employees. Why do they feel like some people should get to skate by in life contributing little and gaining large on the tax payers dime? Don't they value themselves enough to expect the people who work for them to be productive and respect their bosses? I work hard everyday. I expect the people employed because of the taxes I pay to do their job. If my boss came in and told me do do something and I refused, I'd be fired. Why should it be different because they are members of a union?

FYI AGAIN  The ridiculous charge of Mayor Sun destroying public documents is in regards to the Mayor tossing a top sheet of a report on a homeowner from the building dept. because the top sheet did not contain the address of the residence. Mayor Sun simply tossed the top sheet and ordered the building dept. to make another cover sheet which actually contained the address of the residence. OMG. Since Mayor Sun is ridiculously honest he did admit he did this to 2 state troopers who came to investigate. They all went to the homeowners property wherein the homeowner produced the 17 page document and the State Patrol (troopers) verified everything was in order.
That's it. That's the entire destruction of city documents. WOW maybe we should just hang the mayor lol.

FYI the claim Mayor Sun tried to interfere with a criminal investigation is in regards to our Mayor Sun telling Lt. Massey (John Clakins' pal whom Massey personally drove to pick up after many of Calkins run in's with other police jurisdictions) to STOP wasting taxpayer dollars trying to conduct criminal investigations of any and all individuals having the of public records documents regarding councilmember Gary Hulsey's being a convicted murderer who gutted his wife with a hunting knife and later said ooops it was PTSD and booze that made me do it.Â
Massey wanted to investigate and bring charges against anyone who has distributed the public info police reports, statements, conviction data, and etc . Which as any sane person knows is public information the media used to expose councilmember Hulsey for being a convicted murderer. But, LT Massey of the Pacific police didn't like that public info being distributed and/or mailed out for the PUBLIC TO KNOW THEIR COUNCILMEMBER Hulsey is a convicted murderer. So, Massey tried to investigate and bring harassment and other charges against anyone - other than the media - who DARED expose the murderer. Massey was overheard stating that information "like that" given to the public makes it harder for the police to do their job. OMG well that's a reason to try to bring criminal charges against people for distributing public information legally obtained under the Freedom of Information Act. What a joke.
Either way, the majority of the city voted him in. Why don't the rest stop wasting time trying to get him kicked out and deal with it. Give him his opportunity to make the city better, wether he does a good job in your opinion or not he's been chosen by the majority so just let him do his thing. Its a lesson to be learned. Wait till the next election term and if the majority votes him out fine but for now, let him do the job he was elected to do.Â

Pacific is a town where the good old boys and girls get to drive without fear of tickets for speeding or drunk driving their brat kids get charges dropped, they get building permits at a whim, special favors, and business contracts, houses get built without having to connect to the underground storm water system and instead get to build Mosquito infested retention pond after pond which endangers the children as even if they are fenced they are done so poorly young children are endangered and mark my word - one day one of those children will drown in those ponds. Oh the citizens are told don't leave old tires or anything else that can collect rainwater because it's a haven for Mosquito breeding, but builders in the "know" can put these ponds all over Pacific Councilmember Clint Stieger has had a disgusting porta potty in his backyard for some relative living in a trailer back there for years now. It's illegal and disgusting, but Stieger is a councilmembber after all. And that's just the tip of the iceberg. Friends get appointed to comittees to make decisions for the town and others are told there are no openings. It's a joke. And it will stop with Mayor Sun or the city will cease to exist. At this point either option is okay with me as I'm sick of it.  @Windowseat

 @711 Cares The Civil Service Commission is hearing Mr. Calkins' appeal of his termination as Public Safety Director because that's what the Civil Service Commission is there for -- to oversee the hiring, employment, and termination of police, including the public safety director:

A. In accordance with the provisions of Chapters 41.08 and 41.12 RCW, there is created a civil service commission composed of five persons appointed by the mayor and confirmed by the city council to exercise the powers and to perform the duties established by that state law in connection with the selection, appointment and employment of all full-paid police officers, including the chief of police and public safety director.

The purpose of a Civil Service Commission is to deter the sort of corruption that's almost inevitable when police officers are at-will employees. Â If an elected official could simply fire an officer without cause, that gives the official a dangerous degree of influence -- "Don't arrest me or my friends, or you're fired." Â "Go investigate my political opponents, or you're fired." Â To prevent that sort of corruption, the Civil Service Commission can hear appeals from any covered officer who is disciplined or terminated if that officer believes he was mistreated.

The only role of the City Council in this was the decision, many years ago, to include the Chief of Police and Public Safety Director within the jurisdiction of the Civil Service Commission.

RCW 41.12.050 requires that a Chief be covered by Civil Service protection if a department has six or fewer commissioned officers, but beyond six officers a city may exempt the chief and some number of management positions from Civil Service. Personally, I would prefer that we not include the Chief in Civil Service, but that horse left the barn years ago.
 @Joshua Putnam Coverage by the civil service commission - which as you stated is just 5 citizens appointed by the mayor and confirmed/accepted by the city council - is NOT the same as fired ex public safety director Calkins being in the UNION as is the case of the 4 officers. The 4 officers can report to work for now but rest assured the entire legal process for their termination is soon to come. But, that's another subject.
The council putting the chief within the civil service commission means nothing other than he should have been screened better in the first place.
The fact Calkins is not union is exactly why there is NO UNION REP by Calkin's side during his disputing his firing. Calkins is an at will employee who does serve at the mayor's pleasure and as such Calkins' firing is legal. The fact Calkins has the gall to dispute his firing is not surprising to me, but it will not work. The commission does screen officers which serves a purpose, however the commission has NO power to reinstate Calkins period, so it's all a waste of time.
Mayor Sun is not an idiot and he will not re-hire former chief Calkins no matter what the civil service recommends. Sun will not re-hire Calkins because city attorney Luce (soon to be brought up on ethics charges with the WSB) tries to intimidate. It will not work.
 The commission is biased and it is a known fact Calkins is not fit to serve as our or any city's chief/public safety director. So the commission can play act this circus of a hearing when you and I both know they refused to admit into evidence Jane and the finance director Peirce's statements regarding Calkins recent incident of screaming, intimidating, swearing and creating a hostile work environment all because Calkins want for 5 new police vehicles was reduced to 4 by our current Mayor Sun. An extravagant purchase authorized by former mayor hildrith which Mayor Sun inherited and questioned the need for.
The city council's problem is you and the council do not and have never had any respect for the people's choice to elect as a write in candidate our current Mayor Sun. You were all taken by surprise and, frankly, insulted the voters finally put their foot down to elect Sun knowing he would fight against all corruption including the council overstepping their boundaries of the law. It may look to you and your fellow council that you have actually achieved your goal of your anticipation of Mayor Sun being recalled as you and your buddies couldn't bully Sun into resigning, but you are all in for the surprise of your council lives. The council (yourself) is simply legislative branch of government, not the Executive aka Mayor. Additionally these 5 civil service volunteers were NOT appointed by our current Mayor Sun. They were appointed by former Mayor Hildreth.
 @Joshua Putnam I know exactly who you are Mr. Putman and I know exactly how you work. You are a member of the Pacific city council who has no qualms about serving with a convicted murderer because he votes the way you want; You cover yourself quite well with your demure mannerism and your ability to seem honest and sincere and you may have some well intentions. However, you and I both know that the entire city council has refused to confirm dept head replacements stating one reason or another and if you would confirm our city would not be vacant of department heads. I'll post more on Calkins in a minute. You twist things by throwing out RCW's that - on the surface - seem to support you, yet you leave out any RCW's that do not support the picture you are trying to portray. I also know you have been remodeling you home ON THE SAME BUILDING PERMIT for the last six plus years.Â
 @Joshua Putnam  @711 Cares Well if you remember correctly, Councilman, which is strange as you throw out RCW's and cut and paste policy procedures so well . . . if you remember correctly wow. It doesn't matter to me anymore. My wife and I made the decision, yesterday, to put our home on the market and get out of this mess of a city asap. We've lived through too many administrations and it's all the same mess after mess and frankly this town - after 2 terms of Hildreth being mayor - looks like a garbage dump. If you really cared Putnam you and your council friends would drive around and take a good look at what a dirty looking cesspoool our town has become. Homeowners don't take care of their property and haven't for some time and no one at city hall does anything about it. It's time for us to go. The whole town now looks like ousted Mayor HIldreth's property.

They have no hiring or firing authority. That Authority rests with the Executive Elected Mayor Sun. Calkins is not and has never been while employed in Pacific A MEMBER OF THE POLICE UNION. So the civil service can hear all they want and twist all they want and refuse all documents that don't support what they want - bringing corrupt Calkins back to do their bidding. None of it will matter because the civil service CANNOT rehire that drunk ex chief and Luce cannot force Mayor Sun to hire him back and Sun will NOT hire that menace Calkins back, period. So, let Calkins file a lawsuit. I welcome it because then EVERY charge, trial, investigation, on Calkins will be admitted into trial against Calkins and Calkins will be opening up his entire corrupt life - both professional and personal - to the courts and the public. As for your ridiculous comment that the civil service is independent from the council that is a joke. The council - in your own post - has to affirm/AGREEFfor anyone to serve on the civil service which by definition makes the civil service NOT INDEPENDENT from the council. You twist as well as Robert Smith, but frankly I'm tired of playing ball with you. I RECOMMEND EVERYONE IGNORE EVERYTHING YOU POST AS YOU ARE A COUNCILMEMBER AND AS SUCH YOU ARE PART OF THE PROBLEM AND YOUR POST ARE NOTHING BUT BIASED SELF INTEREST POSTINGS.

 @711 Cares  @Joshua Putnam I was not on the City Council when the municipal code was amended to include the Public Safety Director within the scope of the Civil Service Commission.  Nevertheless, as it stands today, the Code does make the Public Safety Director a Civil Service position, which does give the Civil Service Commission jurisdiction to hear his appeal. Â
The Civil Service Commission is independent of the City Council and includes appointees from both Mayor Hildreth and Mayor Sun. Â Â I have not seen the minutes of the appeal hearing and have intentionally avoided discussing it with any member of the Commission to avoid even the appearance of attempting to influence proceedings, so I honestly don't know what has or hasn't been admitted in evidence to date, or what further testimony will be forthcoming at the continued appeal hearing. Â
Please keep our Mayor . Let him clean up our town.

Don't worry Winn your Mayor is not going anywhere. He's tougher than those recall idiots. Come on first the murdering councilmember Gary Hulsey accuses your Mayor of not having the war medals, including two purple hearts, and then it just went on and on one ridiculous s accusation after another. Look who's carrying the picket signs - wife gutting with a hunting knife murderer Hulsey and drunk as a skunk councilmember Stieger, and their groupies. They want to recall a decorated war hero yet they have a convicted murder council member Gary Hulsey leading the pack. Oh but the bleeding hearts say leave poor Hulsey alone - the guy served a whole 8 years in prison for gutting his wife to death poor fellow. 8 years? You have to be kidding? Councilmember Gary Hulsey is no victim and he NEVER made amends because his wife is still just as DEAD as ever. And that "oh I had PTSD and was drunk" BS is just that - BS that got him 8 years for taking a human life. It's sickening. Mayor Sun, I assure you has a legal team and that team is not in front of the cameras for attention and to inflame the public. That legal team is dotting the i's and crossing the t's to make sure your Mayor wins this war of overpaid, self serving, special favor taking power hungry mongrels.
Video I've seen of Mr. Young over the months causes me to think he is out of touch with the reality of running a city and interacting with people. I hope the recall is effective and quick.

I think Cy Young should create a document outlining the problems he's trying to solve and explain his actions.

 @JoeKing Joe it's Mayor Cy SUN, not young. Really you think our mayor should make a document. By the time he did that his term in office would be over as that is how long it would take to document the corruption. Those of us that live here know it. We live it. If Pacific ceases to be a town then maybe it's time. Pacific is over 110 years old and history just keeps repeating itself with corruption and press of Pacific's corruption and problems. Sometimes you just have to shoot a horse if you can't save the poor thing.
