Everett man accused of raping daughter's friend
EVERETT, Wash. -- Police have arrested an Everett man who allegedly gave alcohol to his daughter's 15-year-old friend and then raped her.
Jose M. Garcia, 36, was booked into jail on Thanksgiving morning for investigation of third-degree child rape, unlawful imprisonment and supplying liquor to a minor.
According to the police report, the victim called 911 early Thursday from outside the apartment in the 6900 block of Fleming Street to report the attack.
She told officers that she had been visiting her friends and Garcia gave her alcoholic drinks before raping her, according to the report.
The girl said she told Garcia to stop and tried to get away, but he would not let her out of his room. She even tried to escape out a second-floor window, the report said.
Garcia is scheduled to make his first court appearance on Monday.

Any reason the system can't just load guys like this up on drugs that cause them to be flacid for life and fix the problem all together whether they're on or out of jail? It could be put in the water (drink it, bathe in it, etc...) in our correction facilites and by the time they get out... Oh well!

He will only get about 2 years for this kid didlin in the State of Wa. Laws are tougher on Animal abuse than sex crimes. He'll get his Bubba introduction when sentenced.

Something is not adding up to this story.
Only 3rd degree rape? Makes me wonder if perhaps Garcia is not a legal citizen, and the lesser charge is being brought in order to allow him to stay in the country and not be deported?  Was the alleged rapist's daughter 15 too? That would mean Garcia had her when he was 16? Something seems a bit off about this story.

@kcinkenmore Yes, that was my first thought. And yes, it is a horrible assumption but one that has been accurate before. He most certainly should be accountable for the alcohol provided but I wouldn't lynch him for rape until ALL the evidence is in. I was a 15 yr old girl once with the hots for an older man so I remember all those thoughts, including the vindictive ones when I was turned down. I didn't act on them but plenty of girls do.

If someone did this to any of my little nieces or nephews, or with ANY child and I had knowledge of it and knew it was an absolute fact I'd be in jail, for murder or attempted murder I couldn't say.

Third degree rape is more of a statutory rape charge, not a forcible rape charge. Â Something doesn't add up here. Â
@lakeview The third degree rape charge is because of her age. This was explained to me when my daughters were raped by their uncle. They were six when it happened and so it was first degree. From about 12 to about 14 years of age is 2nd degree and 3rd degree is for older kids. It adds up.

But just the having child element in there divides the levels only by age? So an especially brutal, violent assault would still be "just" third degree if it's a 15-year-old??

@lakeview @Larry*X*K Not true. 3rd degree rape just means that the person who was raped was older than you would get for a first degree rape charge. Peple constantly make this mistake. The degree of rape has nothing to do with how brutal, or not brutal the actual rape was.
Sick. Glad they arrested him. Â Curious where the daughter was when her 15 year old friend was drinking with the father. The best weapon parents have against this stuff is to know who your children are hanging out with, and who their parents are AND instilling in them the confidence to know that when an adult male is giving you drinks, or a parent is letting them drink or do drugs at a friends house, you call your parents immediately to pick you up.  @MaxVonToadenoff In Washington State you can arrest on only an accusation, no other evidence. I was shocked to find that out. I found out when someone I know was falsely accused. his life has been ruined. I do not know what happened in this case, but anyone can lie and after they recant, they face no consequences. I hope the truth is found and the guilty are punished.Â
@MaxVonToadenoff I had to respond to your comment. I am the mother of two girls who were raped by their uncle. The abuse laster for one daughter 3 years and 2 years for the other one. Where was I? Siting in thye livingroom with my mother in law think how wonderful their uncle was that he was teaching them computers and watching Disney movies with them. In this case the daughter may be totally unaware of what happened or be a victim herself and to afraid to say anything. They purposefully don't release much information because the victims are minors. They will not even name them in court documents. The man has been charged and the evedence will be given to the special prosecutors for sex crimes against minors then they will decide whether to charge him. Trust me his constitutional rights will be protected more than the victim or her family. The daughter may be a victim of abuse or not but she is still a victim because her Dad has been named and she has to go to school and face it all. The schools are incapable of helping the girl or making any arrangements. We met so many girls that had gone through this yet with differing outcomes. In our case he was convicted of 2 counts of first degree rape of a child and sentenced to 10 years each count. He served 8 years 4 months and was let out on good behavior.

@MaxVonToadenoff Ever had, or known a child that was raped? The authorities are pretty careful and thorough on cases like this before just arresting someone. Usually, they have enough evidence to convict BEFORE making the arrest, and I'm with the pack on this one. Scumbags like this shouldn't live long enough to SEE a trial. They get special treatment, locked away from the big boys, and never get what's TRULY coming to them. As far as I'm concerned, child molestors and rapists need to be swinging from a tree, rather than breathing.

I use the english language, and caps to annunciate a point seeing as how we all aren't in the same room being able to see each other's expressions and gestures. When someone says they where raped police have an obligation to put them in jail until the facts come out. So lets not get blood hungry here quite yet.
