Guards unlikely to be charged in jail death

EVERETT, Wash. -- Rose Saffioti's 22-year-old son died in a Snohomish county jail cell in July of what she believes was a severe allergic reaction.
Despite witness testimony that jail guards mocked the dying man, on Wednesday the Sheriff's Office announced it would not recommend charges against the guards or staff.
Michael Saffioti had run-ins with the law over marijuana and needed to turn himself in last July after missing a court date. Rose admits her son did wrong, but she said he knew it and wanted to serve his time as he had before.
And in those times, Rose made it clear to the authorities that Michael is allergic to milk.
"They have a huge medical chart. Michael was transported for an allergic reaction before from that unit," Saffioti said.
Through multiple meetings with detectives, she learned Michael was given oatmeal that may have contained milk -- specifically against the medical alerts.
"He got up, got breakfast, needed to use the inhaler twice, kept calling for medical," she said. Michael died that morning.
While the Snohomish County Sheriff's Office declined to suggest filing criminal charges to the local prosecutor, an internal review will follow.
Saffioti wants changes and some sense of justice. She believes something in the system failed her son.
"It's your responsibility to take care of the basic human needs of someone who's incarcerated and can't help themselves," she said.
The Snohomish County Sherriff's Office did not respond to calls or emails regarding the case. They issued a release saying an internal investigation is still pending. The Snohomish County Medical Examiner said Michael died bronchial asthma.

So why hasn't anyone called for the DOJ to investigate the Snohomish County Jail, only 2 people died in 2003 when they were formerly under inquiry from the DOJ, how many more have to die before someone does SOMETHING?

@Common Sense I have heard it said that common sense is not so common anymore, strange that your handle would prove that point. Also interesting is the fact that you would use Patriot Community lingo to try to turn things around on people stating the obvious. That "ambulance chasing lawyer" as you put it was one of the finest prosecutors King County has ever seen. I was not a felon, I spent time in the jail for a misdemeanor, not drug or alcohol related, non-violent. I was refused medical care, I watched cancer treatments being withheld, I watched as people having withdrawals were ignored, not treated, I watched as people died while I was leaving, MRSA & TB run rampant, the guards are in fact Snohomish County Sheriff's & the agency that "investigates" them is the Snohomish County Sheriff. I do have to say that their own ego's & the way that they mistreat inmates backfired on one particular guard. There was a girl with MRSA who was rubbing her face & then running around grabbing handles & anything she thought someone might touch, we tried to tell the guards & were told to shut the f up, I got in trouble for pushing the button to try to warn her & was told also to shut my mouth or I was going in the hole. So I got to watch her sit there & eat her sandwich by hand with all of that pus & crap all over her hands, the best part of my day is when they let us all out & I told her, & pointed out that she didn't even wash her hands to eat, the look on her face was PRICELESS.
Remember, people, that this is the same prosecutor who deliberately threw the case against Everett PD Ofc. Troy Meade in the deliberate and aggravated murder of Niles Meservey; the same prosecutor who had his own wife kid-glove and throw the case against Marysville PD Ofc. Derek Carlile who recklessly left his loaded handgun in reach of his unattended 3-year-old son, resulting in extreme danger to the public and all present and in the death by gunshot of his own 7-year-old daughter: Carlile has NOT EVEN been prosecuted for SIMPLE CHILD ENDANGERMENT!!!
Don't expect this prosecutor to stand up for the rights of ordinary citizens when his cop-buddies are in the pinch: he ONLY cares about people who work in law enforcement or jails/prisons. That is IT: if you do not carry a badge, this prosecutor considers you something to wipe off of the bottom of his shoe.

I recall having the same feeling almost as if the prosecution was only going through the motions to seemingly appease the public. The prosecutions presentation was less than stellar in each one of the cases you mentioned. Â

What a contrast weâve seen in the public reactions when 3 similar, all tragic gun events happened within weeks of each other back several months ago. Prosecutors were immediately ready to throw the book at the parents in Tacoma and Gig Harbor incidents. Sure those folks all looked disheveled when paraded out on the evening TV news, without the benefit of a union paid lawyer. Their fate was doomed from the get-go.

Snohomish County on the other hand pondered, then investigated, then pondered some more attempting to decide if they were going to charge the Marysville cop. That guy, a supposed trained LE professional had left a loaded firearm in a car with children, resulting in one kid blowing the other kid away. I say itâs time for the accountability to begin. What say you?

This is insane. If these guards are not pressed charges or at the least punished in some way for what they did and did not do, then it goes to show you how laughable the system is here in Washington. This young man was a living human being. He had the same rights as both you and I. Yes, he did commit a crime and that is why he submitted himself to the authorities. He did nothing wrong, but was wronged by the system for letting him eat something that was clearly against his medical conditions. How the guards can mock him is beyond me. To me, that just shows me that those idiots are low-life scumbags who hide behind a police enforced area. I bet without their guns, they'd be a bunch of pansies. Nevertheless, these guards are a joke. They were mocking a dying man, let him die, and did nothing to make things better. If you ask me, they deserve time in prison. Let them know how it feels to be in a situation where they are limited in things they can do. I bet then, they wouldn't be mocking anyone anytime soon.

No, really? Officials given no punishment for their role in death. Surprising. And to think this young man died because of marijuana laws. Yes, he may have been given something allergic, but the precursor was something well before that.  This young man could have been alive right now.

You can certainly bet that if it had been a jail guard that had been laying there dying, and the inmates were taunting and making fun instead of summoning help, there would have been some sort of charges brought against the inmates. Maybe we should dismiss them as jail guards and send them down to Seattle to become police officers.......they would fit right in.
Have any of you worked in the prison system? Before you judge the prison guards, maybe you should try working with these criminals day in and out. You have no idea what goes on there. You become numb because you work with rapists, child molesters and murderers.Â
Its a shame what happened to this young man. No one wants to lose someone they love. But, its done. Maybe tis will change the rules regarding inmates with medical issues.

 @agatha This kid hadn't seen trial as have many inmates. Police custody assumes all control over and all responsibility for the incarcerated.
What does working in the prison system have to do with this young man's death? There is something called human decency, and these guards didn't give him the treatment needed to save his life. If you are so jaded you can stand by and watch a young man die needlessly, you don't deserve to breath the same air as the rest of us. I don't care where you work.

Okay, so are you saying that since these guards were working with criminals, they were right to 1) disregard the medical conditions of a dying man, 2) mock him while he lies hopelessly in need of help, and 3) not get any type of punishment for their behavior?
Get a clue. These guards were in the wrong. If they don't want to deal with criminals the right way, then get the heck out of this job. They don't belong there.
 @agatha It doesn't matter what conditions they work under, they have all been trained in first aid and CPR and are required by law to call 911, at the very least, when emergency medical treatment is necessary. If they can't handle working with rapists, child molesters and other hardened criminals then maybe they should get out of the business.
This story is starting to develop legs.Reportedly, Mrs. Saffioti has now hired high profile Seattle lawyer Anne Bremner to avenge her sonâs death and seek answers that SCSO is attempting to hide. This woman is not some fat crazy illiterate gal with pretty pink curlers, standing at the front door of some trailer talking nonsense.

In fact Rose Saffioti could emerge as Snohomish Countyâs worst nightmare. Sheâs a well-spoken suburban mother who seems sheâd be a delightful neighbor, who has a calm demeanor. Although we've never met, I feel like I have known her and her family for years. Sure her son had his battles with pot, but his family showed unconditional love as he sorted out the issues. You canât help but feel her sadness when she speaks.

If the young man were a person of color from the projects in North Everett, very few would care to hear or sympathize. Thatâs just the way life is in Washington, however this case is different.

When many of you see the images of Michael, you immediately begin to identify with him. Maybe he reminds you of your son, your cousin, the guy next door. Judging from photos heâs traveled, visited museums, embraced the arts and dabbled in Cosplay, while possibly attending Sakura-Con the Seattle Anime convention. Nothing so far has attempted to label him as a threat to the community.

There is a community that is taking notice to see how Snohomish County officials explain how this Caucasian boy from a good White family from (Mukilteo) the suburbs needlessly died, because of the gross negligence and indifference of his Negro guard(s).
@Harrison The most bizarre thing is that all of the people who have died in this jail are in fact Caucasian... further proving neglect in general & showing what little regard they have for any life in general.
This is a sad thing indeed-with a medical alert listed more care should have been taken toward his allergies. I am sorry. I don't believe he deserved to die. But, being in this situation you take your life into your own hands by being in jail and being in the care of people that have alot to do, alot to worry about and I'm sure they hear it all in there.
Why would you charge someone for saving taxpayers money?
Staffioti was put into jail for breaking the law and missing court dates, it was his fault for getting into the situation in the first place. No sympathy for someone that breaks the law. He could of refused to eat the oatmeal that possibly contained milk.
If it was an alleged child rapist that had an allergic reaction to milk and died, would you care?

I can't believe that there are people on here who insist on blaming the victim. How many of you have ever suffered anaphylaxis? I have and it is absolutely terrifying to know that you are going to suffocate if you do not get medical attention in a timely fashion. Take the fear that accompanies suffocation and then imagine being locked in a cell and the people there who could summon help, who's job it is to summon help, choose instead to taunt and tease you as you lay there dying.

In my book these guards tortured this man to death, and should be charged accordingly. And anyone who implies  that he some how deserved it or brought it on himself just because he was incarcerated or didn't check the ingredients (which he couldn't by the way) is completely heartless and should be ashamed of themselves.

I feel and sympathize with the Motherâs loss, to have a son taken at such a young age for a senseless and preventable cause while under the control and responsibility of others. Yes, I feel Snohomish County and those employees should be held personally responsible for their alleged negligence.

We have all recently seen the Mom on the news and I mean no disrespect, as she is clearly not media savvy. I do feel she has an important story to be told and really needs a seasoned media consultant and high profile attorney by her side, as part of her team if this story ever has a chance of going beyond a regional blurb and breaking into a national conversation.

Mom comes off as a nice Middle America mother that many can relate to. When you see this young man, he doesnât look like a âcriminalâ that would make women uncomfortable while clutching/hiding their purses. Donât just think about filing a lawsuit, DO IT! Make sure your ask is a significant âreasonableâ dollar amount that commands attention. The bigger the dollar amount, the closer to the front page of the newspaper and above the fold you get.

 @Harrison Hm. We have wondered if we have a case at all. Ultimately, the goal would be to bring awareness regarding better monitoring and care of prisoners with medical conditions. Although, with the healthcare we are receiving outside of the jail, it almost seems futile.Â

Having only the County cover any future financial awards does little to change apathetic attitudes. SnoCo officials will most likely attempt to keep the incident âunder investigationâ as they try to run out the clock, waiting for the Mother to just go away.

A. The guards are not being held accountable, as Michael was not in a position to simply mozie on down to the Providence ER on his own.

 @Harrison  @Gabby If you are really the mother, you need to speak with an attorney ASAP- I recommend Messina Bulzomi Christenson (Jamie McCormick is quite good in my experience as co-counsel) or McDonald Hoague & Bayless. Both firms are good, and have the resources to pursue what looks to me as a case for significant damages. Good luck, and don't let your son's needless death be in vain!Â

Someone should have been charged with manslaughter. Someone did not follow protocol and someone died for it. I hope the family sues for a couple hundred million. Just more proof we are not a nation of laws any more. Laws are just for the little people.

My friend's 9 year old son has severe allergies and KNOWS that if his parents are not around to check the ingredients, he should not eat any food that is offered to him. I would think at the age of 22 a person should be capable of ensuring the food he is given is not something he is allergic to, or to not eat it if he has any concerns about it. At some point, people need to be responsible for their own safety.
 @Ima Souperconservative It is one thing to insure the food you are eating has nothing you are allergic too. Let's assume that he did mess up and did not double check. That that still excuse not getting medical attention, when it was obvious he needed it?

 @Ima Souperconservative As I recall from a previous story, he asked before if there was milk in the oatmeal and was told there wasn't. Hard to read a label if you're not preparing the food. And he was incarcerated... was he supposed to wait til his mom showed up or just starve?

I BLAME THE JAIL, and I'd sue the living hell out of them so bad that Governor Inslee himself would ring their necks for the amount of money lost in my case. It was very unprofessional, unconstitutional, and irresponsible of the jail to for one mock him and pretend he was faking it, and for two to deny him medical accommodations as they are BY LAW supposed to. OUR LAW ENFORCEMENT doesn't even follow the law, ha. So much for everyone playing by the rules I guess. Those guards are heartless and this is disgusting. I'd be furious if I was any of his family members, especially his parents. I hope they sue so bad it causes a challenge in how things are handled in jail across our state.Â
