Lawmakers eye gun surrender for restraining order
OLYMPIA, Wash. (AP) - Washington state lawmakers want people to surrender their weapons when they are placed under a restraining order.
The Housed approved a plan Tuesday evening that would prohibit people from possessing a firearm while a protective order is in place.
Democratic Rep. Roger Goodman of Kirkland says the bill will help keep victims of gun violence safe.
The measure passed 61-37 and now goes to the state Senate.

When does this take effect? If the cops get your guns, will they now have an excuse to make you register them? Will this permanantly screw with someones record? So many question. I don't even think my guns are safe in my fire proof safe!
It's been in place in Texas for years, one of the gun-friendliest places on Earth.

This is terrible ideas because almost every angry wife is advised by her divorce lawyer to put restraining orders on their husbands to make them look bad in divorce court custody battles.
@Goodwin Are you an attorney in real life?  Your debating skills are top-notch, you get to the point and you are educated.  Nice to have someone like you in the forum.
@Goodwin Being the victim of domestic violence (many many many years ago) I could see a legitimate case for this, but I really dont know how you would implement this and have it be in any way effective. Too many people abuse the restraining order process for frivolous things, and the women that really need it tend to be left out in the cold. Too many loopholes in our system and it would not be effective anyway, a person wants a gun, they can find one. Do you know what the police told me? They suggested I leave town, with my stitches and bruised and blackened face and 1 year old child... That they could not protect me and a piece of paper would not help either. The truth is, they were right and I left town.Â
That restriction is reserved for felons. A protection order defines contact - not personal property.
Even if it passes the senate, once it hits the courts, it's doomed. I agree - a total waste of time.Â
@Audio Cat Agree but I also believe only violent felonies should lose this right.  To me it has always seemed like a back door to gun confiscation especially how many things have been added to the felony list.

Maybe the state will charge for gun storage so the can balance a budget or fund some other idiot program:)
@Linc239Â They charge you to go to jail, it just seems to follow suit that they would charge for putting your gun in jail, and if you couldn't pay, insta-auction. They think like that.

What are firm statistics on Washington State residents committing gun violence while under a restraining order that would lead to such a restriction being considered?Â
Anyone here actually believe this proposed restriction has anything even remotely to do with keeping people who obtain restraining orders safe? Â
@Opus8no5Â Your asking for facts and hard numbers. Â The state legislature should but isn't able to provide this cause this is a feel good "common sense" law. Â The writer of the article though should have asked this and gotten some information.

i had a pissed off mother of a girlfriend of my son slap a restraining order on me and my son because she didn't want her daughter hanging out with him.. i do not know what story she told to the judge.. but I had to go to court to defend the spurious allegation, and of course, she didn't even bother to show up .. soo. now lawmakers want me to surrender my firearms because someone, without my knowledge until the king county police showed up to serve it, filed a restraining order against me ? this concept has already been struck down by the 5th circuit court of appeals... whoever voted for this and sponsored it, needs to be thrown out of office for wasting tax payers dollars in the inevitable losing lawsuit.Â
@everyoneelse You do not know the story she told the judge? You are not being truthful. When you get served the order, part of the order includes her application for the order which states why she wants it. It is served to you along with the judges order.
@K00lGuy @everyoneelse I am being quite truthful, i suppose i could try and find the paperwork from 8 years ago.. i know what "caused" her to go batsh*t crazy, ..that is, that her daughter spent the night at my house with my knowledge (they had been dating a year, and were 17 at the time) but dont' know what she told the judge that caused this to be an "emergency" requiring to KCPD's to serve at 11p the next day.  noo excuse for a restraining order or cause to turn in my guns.. not even related. .. that was a well-to-do crazy lady with money to spend on an attorney.Â

In some jurisdictions around here, restraining orders are handed out like candy by judges at ex-parte calendars just on one persons' word/statements. They are used as swords instead of sheilds by alot of people.

And the lawmakers wisdom is that the person who will break the law while violating a restraining order, will hand over the weapon beforehand? OK good luck with that. They are a crafty bunch, I will give them that

One chip at a time. These idiots will find ANY way they can to take people's guns, and it's so paranoid and ridiculous it's a joke. A scary joke. I've always been a law abiding person. I work, I pay taxes, I support my family, I hunt, I fish, and I own guns. If these idiots succeed in their plan to "disarm" the American public, I guarantee you one thing. I WILL be a criminal, because I will NOT give up my rights to a bunch of paranoid, gun hating control freaks. THIS rights battle is so huge, the anti gun crowd will need to buy guns of their own in order to try to enforce their agenda. The rest of us are waiting.
