Ore. man who left gun under theater seat has permit revoked

PORTLAND, Ore. (AP) - Gary Quackenbush, 40 years a gun owner, was stuck in a stiff, unforgiving theater seat. The movie he paid to watch was running three hours. It was long, boring and left him miserable.
Quackenbush says he spent much of the "The Hobbit" wriggling, trying to get comfortable. At some point, his pistol fell out of his holster.
The semiautomatic was loaded. According to police, its safety was off, and there was a round in the chamber.
Quackenbush says he didn't notice the empty holster until he was nearly home Tuesday. He tried calling the Tillamook movie theater, but no one answered. And when he arrived Wednesday to retrieve his weapon, he found some shocked middle school kids, a gaggle of press and a police officer.
A seventh-grader had found the loaded weapon under a theater seat and notified adults.
Quackenbush acknowledges that, if there was a bad year to leave a gun in a movie theater, it was 2012. Shootings at a Colorado movie theater, an Oregon mall and, most recently, a Connecticut elementary school, have many people more concerned than ever about loaded weapons in public places.
Quackenbush said he always keeps the gun loaded with a round in the chamber because never knows when he may have to use it.
"In a time of crisis like somebody barging into a mall or a theater, you don't have time to do a two-handed cocking of the weapon," he said in a phone interview. "It is my mindset everywhere I go."
Quackenbush said he lives in a rural area where bears and cougars abound. He said he's had to fire his weapon to scare off animals but hasn't had to fire it a person.
Mass shootings in recent months, including the one that killed 12 people at the Aurora, Colo., movie theater, could have been averted - or the casualties lessened - if someone besides the gunman had a loaded weapon, Quackenbush said.
"If somebody had been prepared, they could have stopped those perpetrators long before they were able to commit those horrific acts," he said.
Tillamook County Sheriff Andy Long said Quackenbush's case was handled by city police and information was forwarded to the county district attorney, who is considering whether to press charges.
A sheriff's deputy drove to Quackenbush's home Thursday and took his concealed weapons permit. Quackenbush can reapply for a concealed weapons permit as long as no criminal charges are pending, Long said.
"He shouldn't apply for it soon," Long said.
Quackenbush said that after trying to call the theater Tuesday, he spent a sleepless night pacing before driving to the theater early in the morning.
"I'm totally appalled at the incident and embarrassed, and regret that I gave people distress," Quackenbush said.
Of the movie "The Hobbit," his review in a letter to media organizations explaining the incident was brief: "Overly long," he said, "and fairly boring."
Owing a gun doesn't mean you should have a gun. Â This gun is a dolt, apparently he also recently had another gun stolen out of a store he runs too. Â How did he get a gun? Â There are not that many 'wild animals' he needs to scare off in the 97141 zip code. Â Hope he never gets a permit again too many nitwits out there who haven't a clue.

I'm more concerned why anyone like him was allowed a fire arm of any kind, he gives a bad name to responsible gun owners everywhere.  This isn't the first time recently he's beend missing one of his guns.  @ButtercupSprinkles Trouble is there are too many guys and gals like this that make 'gun owners' look bad and end up hurting other people with their stupidity if they don't accidently kill themselves first.  97141, has lots of poverty, lots of meth makers and addicts of all kinds also a high ratio of domestic abuse.  I'd like to see lots more training for those apply for a permit to carry or own a gun because their dangerous to everyone with their stupidity.

This man is the reason so many of us, who feel free to walk around unarmed, are so concerned about those that walk around with loaded weapons. There is no room to be careless with a weapon. There are far more accidental discharges, than there are cases where the weapon averted a disaster.
 @justmyopinion I agree that there is no room to be careless. I however am going to have to disagree with your last statement. You don't hear about 99+% of incidents that were averted due to a good guy with a firearm.Â

For those who carry a gun there is many times a defining incident that caused the desire for extra protection. I was held up at gunpoint before I was of legal age to carry a pistol. Perhaps your first thought is that I was engaging in some illegal activity or in a bad part of town. Well, sorry to disappointing but I was sitting on a bench at a bowling alley waiting for a ride from a friend. I was held up at gun point for reasons I will never understand but according to the bad guy "I looked at him funny". Here is the kicker. I diffused the situation and the guys went back into the bowling alley. I of course call 911 immediately and report being held up at gun point. What do you think the response time is? 1 minute? 5 minutes? Nope, 45 minutes. I would have had to been shot before they would have hurried up. I'm not willing to risk that again.

 @justmyopinion If this is your "main" reason then you need to look at reality. As to AD vs disaster aversion how are we to know one way or the other since so much of both go unreported and even when reported they are not tracked.
I've read a story where a police officer left his pistol in a public bathroom stall, so no one is immune.
 @pensguy76 Come on Pensguy76, We're not talking about anyone we're talking about a guy that obviously got nothing from any gun training he's recieved. This area is full of people that don't know up from down but they tot a gun cause it makes them feel like they're in control of something.  They're not in control of anything and are a danger to others because they are not fit to carry a gun.  It's a crock when he says he needs it to scare off wild animals.  A few weeks before this same guy lost a gun out of the store he works in...  I'd like protection from this guy and others like him.
 @justmyopinion I understand what you're saying but statistically, I don't think that's true. Just look back through the news articles here and you'll find many times that people have protected themselves from home invasions and the like. It's just that any gun accidents are too many.

@Willow @justmyopinion - while I don't know whether the claim of 'more' is accurate, I do know that there are many incidents of accidental discharge out there. We do know that most accidental discharge incidents don't get media coverage unless a child is the victim or it's a blatant act of extreme stupidity such as the ones where a cop who is a gun safety trainer is giving a gun safety class or lecture and manages to shoot himself or otherwise accidentally discharge his weapon DURING the class/lecture.

That man should not be allowed to own any guns. He was irresponsible and stupid beyond measure. There is no excuse for what he did. Period.
That was really irresponsible of him, and he deserves to have his permit revoked. I don't care how long he's carried a firearm safely because it only takes one bad decision to cause a problem. He was extremely lucky that the people/kids who found it were smart enough to immediately seek help. Never become complacent with a firearm.

i have a ccw permit but i dont always carry but when i do i never forget i have it with me im always aware thats its there this guy was careless and he deserves to have his permit pulled.this could have turned out real bad im glad it didnt good job kids you did the right thing.

It is unfortunate, sometimes deadly unfortunate, that every single one of gun owners are not responsible.  Having your piece ready to fire at all times seems overly paranoid.

Ok, first off most semi-autos with a round up the spout are only marginally safer with the safety on than off. Some models have a 'hammer lock' feature that won't allow the hammer to go forward if the weapon is dropped, but that's not common. And to be clear, an unloaded gun is an expensive club, nothing more.

HOWEVER, that does not mean the 'piece was safe. The owner left a theater without securing his handgun and that is about as unsafe as it gets. While I don't think criminal charges are appropriate, I do think that Mr. Quackenbush having to go to court to reinstate his carry permit is perfectly fine.
@svensson very nicely said.. one more thing to add... it should be about 12 months before he should even be able to apply for a concealed weapon permit, and must attend some sort of firearms training, in order to get it.Â
That, I think is fair.. I don't know how they could make any criminal charges.. but, in my opinion, the lesson has been learned.. Now, it will also be a few months before he gets his gun back too..

My semi-auto pistol does not have a safety..just a decocker, with a double action trigger pull. When I do carry it, I always have one in the chamber.

Even in a noisy movie theater, how does a loaded weapon fall under the seat without making a racket?
@Joy Johnson Maybe it was during a loud explosion or he's losing his hearing. We can only speculate, but I highly doubt he left it there on purpose.

 @Komo Dragon You are right, I dont know about 911 necessarily, but he certainly could have called the police non emergency line certainly and told them the weapon was there. It probably would have been received better that way I'm sure.
 @Susabelle  @Komo Dragon Debatable, loosing a firearm inside a crowded, when open, movie theater could easily become a life threatening emergency. I was the victim in a moderate rear end collision recently and called 911 and they had no issue. No substantial injuries, both cars were drive able, we weren't blocking any traffic. Yeah it needs police attention, but it wasn't an "emergency". Don't call 911 to change a tire, they hate that, but if something needs immediate law enforcement attention, do it.

And when it's after hours, even the regular business lines auto-route to the 911 dispatch center.Â
 @Susabelle that's what I meant. It's o.k. to call 911 in non-emergencies and have them patch your call to police or other public safety depending on your circumstances.Â
