Prisoner accidentally released from Clallam County Jail

PORT ANGELES, Wash. -- A man charged with domestic violence assault was accidentally released from the Clallam County Jail Tuesday afternoon and deputies are still looking to recapture him, officials said.
Lavan Lukes, 35, was being held on $5,000 bail for a charge of fourth degree assault, but upon his court appearance, was released along with several other prisoners being out processed from the jail, said Ron Sukert with the Clallam County Sheriff's Office.
Lukes has yet to be found, and officials have notified his alleged victims of his release. Meanwhile, a warrant has been issued for his arrest.

It's jail not prison thank God. Â I bet this happens all the time in jail. Wonder if there any stats on it...

This sometimes happens when a prisoner is being held on more than one charge and is released on one charge but not on the other. The jailer sees a release paper and lets him go before he realizes that there was no release on the other charge.
I wouldn't get too excited about a guy who was being held for 4th degree assault. He will probably go have a few beers and then turn himself in.
They'll find him after someone else gets hurt

wow, really. how do you accidentally let the wrong person go? ho wdumb do you have to be, thats what you get when you let computers do all the work. not saying thats what happened but jails roster is on the computer and people believe everything they say. youmust really not like your job to let this happen. someone should get fired over this.
I have a question. If a prisoner knows he's being relieased in error, but leaves anyway.....can he then be charged with escape?

 @achoo2 Question is, how do you prove that he "knew" not to leave? I think it would be a hard charge to stick, especially if the jail staff made the error to release him......
@dg54321  Here's a crazy idea. Since this seems to happen more often than it should, why not have the prisoners sign a paper before boarding the bus that signifies they understand they are returning on the bus unless "properly"released by the judge? Then if they skip on these mistakes they could be charged with escaping.  Maybe then they'd think twice about letting the mistakes take place.

@dg54321  I see.  Seems like they need to put some kind of fail safe into play because I swear this is like the 3rd incident I've heard of in the last 6 months.
 @achoo2 I don't think what you describe has any legal backing. Jail and prison are two different things, for one. Jail is right downtown in most counties and there is no "bus" to speak of. When you are released you are told to go and you don't get the option to stay. Jail is where you go before being convicted. Prison is where long term prisoners go to stay after being convicted. Secondly, no piece of paper is going to stop anybody from leaving when the guard tells them they are free, and there is no law to back up that piece of paper anyways. If you are released, you are released. The only way it would be escaping would be if you were not released and left without permission. It's on the people running the jail to ensure they have their facts straight before signing off on release paperwork for a prisoner.

RCW 9A.36.041Assault in the fourth degree.
(1) A person is guilty of assault in the fourth degree if, under circumstances not amounting to assault in the first, second, or third degree, or custodial assault, he or she assaults another. Â Â Â Â (2) Assault in the fourth degree is a gross misdemeanor.

 @Zoso It's too late for that Zoso. However, asking questions is one way to get answers. I truly did not know what 4th degree assault was and now with the thanks of anonstanwood I presume it's DV. Also, throwing a beer on your live-in partner would be 4th degree assault. Domestic violence. A gross misdemeanor. Thanks to you I did look it up and educated myself.

 @Rockberry Domestic Violence is charged as 4th degree assault, and it's not a laughing matter.  This guy is dangerous out there on the streets, I just hope they catch him soon, before he finds his victims and hurts them.
Uh oh. Hope the victim(s) are in a safe place.
Oops...so I wonder if he has a clue that he wasn't supposed to be let out. I doubt he would question it, however.
