Suspect who punched elderly man won't face murder charge

EVERETT, Wash. (AP) - A Lynnwood man who robbed and punched a 91-year-old man at an Everett gas station will not face murder charges.
The Everett Herald reports the Snohomish County medical examiner's office was not able to determine if the punch, which knocked down Harold E. Caywood, was the cause of his death weeks after the violent robbery. The medical examiner said Caywood had other pre-existing medical conditions.
Prosecutors then decided not to pursue murder charges against Patrick Hartness.
The 26-year-old Hartness admitted on Friday he robbed Caywood in August. Prosecutors want a 10-year sentence.
Caywood's family says he was a World War II veteran, who before the attack was an active man, making elaborate beading projects that won prizes at the Evergreen State Fair.

AMAZING how the law continuously protect criminals and killers. Will Snohomish County medical examiner office's findings be different, if the dead victim is their love ones? Should this poor victim pay part of his estate to this criminal for wrongly putting him through all this trouble to even think he have anything to do with this victim dying on him. This poor victim is healthy enough to fill up and drive his own car, if he have this much health issues, he wouldn't be driving nor filling up his own gas. This poor victim is very independent, and have many more years to go. Evil like this POS, who picks on, robs, hurts, injures, and killed the elderly deserves a seat next to Josh Powell.

@nunof uors They are not weapons of war they are going after. The ban refers to characteristics that have NO effect on the operation of the weapons. The bayonet lug holds a bayonet, nothing else; folding stock does not effect the bullet, and the pistol grip on the guns do not effect the gun. These are things that simply look scary. I remember when they struck down that law about intent to kill, when you attack someone. Washington State has the weakest laws and judicial system.  The criminals seem to serve little time. I'd hate to be a cop here. You risk your life to get these cretins off the street, and they're out in a few years.  Remember the story says the Prosecutor WANTS 10 years, that does NOT mean that the judge will even give him that. It's not a done deal. he could give the guy a few year + probation, even with his history.  Trash California all you want, which is a hobby here, but they are serious about their justice system.  A guy like that with that history, would not be walking out  in a few  years.Â
Yet another predatory loser wrecking havoc on society. People, don't have kids if you aren't going to raise them right. Respect for the eldery is a no-brainer except if you are a lilly livered sissy, who doesn't want to work to earn his keep.
And he probably won't even serve the fiull 10 years if it is given at sentencing - they will give "time served" as a credit against the 10, allow time off for "good behavior" - he'll probably be out in 6-7 years.

 @LocalLady Yeah, you actually read the story. The prosecutor will "ask" for 10 years, that doesn't even mean he'll get it. It could be 7 years or less - credit - minus "good behavior"

Pre-existing medical conditions or not...a violent punch to the face and subsequent knock down, to an already frail elderly person will easily result in death. This is ridiculous. Shudder to think what the victim's family has already been put through, and now, more salt in those wounds. Way to go justice system!!
@skepticaloptimist I feel bad for his family. Mr. Caywood was 91 and getting around by himself. What a lot of hogwash to rule "pre-existing" medical condition. What 91 year old or these days 20 something doesn't have some sort of pre-existing medical condition.

The criminal, Patrick Hartness showed up in Washington Courts data base 36 times. He needs to be put away for longer than 10 years.

Its obvious that the assault at least contributed to the victims deteriorating condition and death. That should require at least a manslaughter charge. When he gets to prison someone should spread the rumor he's a pedophile. Prisoners love to show pedophiles a little love.

This is utterly disgusting. Having the nerve to punch a man that is 91 years old is straight up lunacy. This guy should be charged with more than 10 years. In fact, if he's been targeting elderly people, he'll most likely do it again after he is released. Why not keep this creep in prison until he's around 70 or so, until he's an elderly person himself.

according to the other story on him he has been preying on elderly for a while and needs life in prison. why let him out in 10 years to offend again? heck charge him with civil rights violation were he took away Caywood's rights by attacking him. We will be reading about Hartness again in 11 years how he killed an elderly person after being released from prison.

That would add some "punch" to the charges and sentencing if the perpetrator, Mr. Hartness, is convicted. If he's convicted and in prison til he's the same age as the man he punched and robbed would give him plenty of time to reflect on his brutal and ugly behavior.
This all goes back the that Law (sorry, don't remember the name) that passed/was repealed about 4-5 years ago.

If you "Assault/Beat/Push/Punch" and they Die - you CAN NOT be charged with Murder if you only meant to "Beat them Up o& Not Kill them"

That is how the Tuba's mans Killers got off - several other sentences have been reduced in the Prisons from Murder to 1st degree assualt or armed assaults, w/e....point is....if you say "Well, I didn't mean to KILL him, only Beat the Living crap out of " you won't get charged w/murder. Like the guy who was at the Bus stop a year or so ago, punch only 1 once, but fell and hit his head & died....dude was only charged w/simple assault, even though he killed the guy by his actions, but since it was 1 punch.....so no Murder Charges.
