Judge denies request to stop anti-Muslim film clip

LOS ANGELES (AP) - A judge on Thursday denied a request seeking to force YouTube to remove an anti-Muslim film trailer that has been blamed for causing deadly violence in the Muslim World.
Judge Luis Lavin rejected the request from Cindy Lee Garcia, an actress who appears in the clip, in part because the man behind the film wasn't served with a copy of the lawsuit.
Garcia has said she and her family have been threatened and her career damaged since the 14-minute trailer for "Innocence of Muslims" surfaced.
"Emotionally, I am very disturbed," Garcia said before heading into court Thursday.
"My whole life has been turned upside down in every aspect," she added. "My family has been threatened."
Garcia said she was duped by the man behind the clip and that the script she saw referenced neither Muslims nor Prophet Muhammad. She said she was shocked when she finally saw the end result.
"I think it's demoralizing, degrading," she said of the film. "I think it needs to come off."
On Wednesday, Garcia filed a lawsuit for fraud and slander against Nakoula Basseley Nakoula, the man behind "Innocence of Muslims" who has gone into hiding since the trailer rose to prominence last week.
YouTube has refused Garcia's requests to remove the film, according to the lawsuit. The complaint contends that keeping it online violates her right of publicity, invades her privacy rights and the post-filming dialogue changes cast her in a false light. "(Garcia) had a legally protected interest in her privacy and the right to be free from having hateful words put in her mouth or being depicted as a bigot," the lawsuit states.
It's unclear who uploaded the trailer to the site. The clip has been linked to protests that have killed at least 30 people in seven countries, including the U.S. ambassador to Libya.

Alright, I can understand defending your ability to make a living. Hell, isn't that what unions strike for all the time? Still and all, this woman cannot, CANNOT actually think that there was going to be no blowback from the movie she willingly took part in. She knew full well upon reading the script that the film was a satire of Islam and is now saying that the airing of the movie is something that damages her. That's total and complete bulldung.
".... Â keeping it online violates her right of publicity ...."
Â
Okay...granted civics was first period, and may not have always been 100% awake, but what the heck is a "righyt of publicity", and where, exactly is it mentioned in the Constitution or Bill of Rights?
The apologizer in chief has approved of spending $$ to air an ad in Pakistan apologizing for this video. You can see it on the Pakistan embassy facebook page.

how well do you think appeasing these animals will work?
@LockesChild President Obama is delusional if he really believes this is about a stupid film.
Thatâs the way it goes. I have read many comments from actors who did not like the way things went after the cutting was done. Some had their whole part end up on the âcutting room floorâ. That seems to be the way films are made. Often with more than one ending, which they often include on the DVD. You are paid to learn a script, act the part, and hope the check does not bounce.Â
This video has been soooo promoted by Hillary maybe she is partly responsible for its being used by the muslims world since 9-12-12.
Funny you can go on YouTube and see almost 10 different anti muslim video's that have been there since 2009 through 2012 besides this recent one. Amazingly the content of most of them is almost identical to this recent one.
This video is a excuse for a synchronized muslim world demonstration against Obama.
They hate the man who ordered the killing of Osam
They hate the man killing a recent Al Queda leade last month in a drone attack
They hate a muslim gone christian
In Libya you got to pay for making a deal with the devil, what fool Obama was...............

Â
Yeah we don't take away freedom of speech in the USA just because a bunch of hoodlums in another country hate a film made in the USA and decide to kill people and tear up their own country about it.
Find out who the man behind the fraud known as Obama really is.

So how is this free speech? Nakoula changed the end product and misrepresented this film to the actors. Thus inciting riots and death. Where is common sense?
@mr_sandman It's ironic that you mentioned "Common Sense", because that's the name of Thomas Paine's Pamphlet that lead to the Revolutionary War.
@mr_sandman She got paid by exposure or money to do it. The director can do anything AFTER the fact to change it to his liking. If you want to kick the 1st amendment down don't forget what the .gov can then do.
Well, personally I wouldn't mind seeing it go, but yeah, there is a thing as Freedom Of Speech! And all those pathetic whiners over there need to quit getting so easily offended by every damn thing! Are we supposed to be offended by them burning our flags? If they hate us so much, then why are they buying all these flags? Is there an Ahmed's Drug Emporium having specials on American flags? LOL! Good grief! Talk about obessive!
Â
Besides, it's not like that attack wasn't already planned before that trailer surfaced anyway, so maybe we need to quit using that as an excuse.
I wonder what the Muslims would do if every country distributed a film like this on the same day? Would they hate the entire world?I hope they realize how rediculous they are.Â
How many embassies were overrun when this was created? http://en.wikipedia.org/wiki/Piss_Christ
Good for you Judge! Freedom of Speech should be allowed!
For an actor your face is your brand. This Nakoula guy damaged a lot of people with his nonsense. I guess people in show business have to be more careful who they work for. Actors are generally happy to be working at all, especially these days. I can see how easy it could be to get into trouble with asses like Nakoula out there. He's as bad as a child porn producer, worse maybe although I never though I'd say that.
With the Islamists, it is  always some cartoon, play, book, teddy bear, hand puppet show, disk drive, graffitti, smoke signals, carrier pigeon, satellite upload, Voyager1 gold plated album, Draw (The Prophet TMNBN Day), TV show, movie, video podcast, tattoo, hieroglyphic, runes, etc... to cause offense.
Â
The White House lied (poorly) about this film and the terrorist acts committed.
If Libya was a preplanned terrorist act, then the 14 other odd "protests" around the world that have resulted in the attacks on US embassy's were also preplanned. The only story I've read involves the possibility that coptic christians, some cult in Egypt did the killings. A connection could be made between the coptic christians here who made the video in the US and those Coptics Christians in Egypt that went to Libya to carry out the attacks. Â
Â
What I don't want to read is that the radical cult christians here that were both involved in this video have some kind of link to the coptic christians in Egypt that carried out the ambassador and his teams' death. That would be a game changer. That would mean we have active christian terrorist cell attacking the US both domestically and internationally.
Sid, there you go again, you should work at FOX. Facts are not your strong point. Your first paragraph was fine but The White House lied? Really?
"Egyptian cleric and talk show host Khaled Abdallah, one of the first to broadcast scenes from the film, said that although he had no regrets, he was âshockedâ at the fury spreading through the Muslim world."
Â
He also acknowledge that he set the spark for this round of violence and took the video down and will not show it again. He also said he did not regret showing it.
Â
Good audition for FOX, you ought to send some of your to them.
@snoopy84  Do you honestly believe that the embassy was attacked because of that video? Think think think.... it was preplanned!
@Sid Vishess It's spelled Snowe. And because she stepped down due to a Karl Rove/Koch Bros. incoming primary challenge, the Republicans could easily lose another seat in the Senate.
Â
Not sure why you brought that up, but it's a bad thing for Republicans, not good.
Â
Go look at the polls in these senate races. The Democrats were in real trouble of losing the senate. Now it looks like they may actually pick up seats. Thank you Mitt Romney.Â
@snoopy84 Olympia Snow is a Republican from Maine. In the rest of the country, she would be a Democrat.
What I beleave is what Sid said in his very first paragraph about that part of the world. I do think the two are connected. Before I call it a terrorist attack, I'll for the investigation. It won't take much to convence me but facts are always a good thing.
Aslo, to have a republican say she was appalled is not supprising, how ever it turns out.

 @nitroxman:Â
So, if the repubs helped to write it in the firt place, why did they not write it so that it was funded?
Â
Just another example of them saying one thing, doing another.
Even have a clue why they blocked it? OH, fact check, nothing was filibustered, they blocked it with a budget point of order. I am sure you will not look into why they did it, just chant republicans bad, republicans bad.
Â
It was not actually funded, just unstable gimicks, and the Senate was violating the budget rules.
@Sid Vishess @snoopy84
Â
The truth is the Obama administration failed to put our embassies (even in the Middle East) on a heightened state of alert for the 9/11 anniversary. They ignored warnings from both Egyptian and Libyan security about the deteriorating security situation. And when the embassies were attacked and our ambassador tortured and murdered they lied to the American people to cover their own incompetence. To make matters worse with a dead ambassador and the Middle East on fire Obama ran off to campaign in Vegas as though nothing had happened. Meanwhile our mainstream media ignored the truth and instead focused on Romney's supposed "gaffe." Thank goodness for the foreign press that reported the truth from day one!
@Sid Vishess You're right, you are better at being off topic. I try to stick to the facts because I care about the truth more than scoring cheap political points off of dead Americans.Â
@snoopy84 "Self-evident?" Yeah, to all the rest of us.
@snoopy84 Yes... I am good. REALLY good.So Carney Barker comes out and says;.
Â
âIt is, I think, self evident that what happened in Benghazi was a terrorist attack.âÂ
Really, this Republican senator who is appalled at an investigation that is not complete nor has Clintongprovided her briefing yet. Now you sound like Romney-your good~!
@caphillkid Issa is one thing but when you have lost Olympia Snow...
@caphillkid Even after they knew what happened, they continued to play CYA (LIE). Did you see Linda Rice hammer those points home like she was Mark McGuire at the plate on the Sunday shows?
Â
Bush= faulty  Iraq WMD intelligence=lie
Â
Obama=faulty intelligence=chaos, not his fault (nothing ever is)
Â
Your second paragraph is OT. You simply aren't in my league when it comes to interweaving OT stuff into a thread.
 @Sid Vishess veterans job bill
@Sid Vishess  Sid the embassy was overrun, it was chaos. The administration probably didn't know and assumed it was part of the demonstrations. Sometimes it's hard to know exactly what happens thousands of miles away when your contacts on the ground are killed. Frankly, you are stretching when you call it a lie. There is no evidence of any lying. But don't worry, Darryl Issa will probably hold a hearing on it soon enough.
Â
Meanwhile yesterday Senate Republicans filibustered the bi partisan veterans job's that Republicans helped write. 58 yes votes wasn't good enough to overcome that pesky Republican filibuster. Jobs, jobs, jobs, right? Â
@snoopy84 Please feel free to spin how they didn't lie about it. Go ahead.Â
@snoopy84 "CBS News reports that in Benghazi there was never an Anti-American protest at the American Consulate, just an attack"
