Subway sued over short 'footlong' sandwiches

MOUNT HOLLY, N.J. (AP) - Two New Jersey men have sued Subway, saying the world's biggest fast-food chain has been shorting them on its so-called footlong sandwiches.
The filing made Tuesday seeks compensatory damages from the company and a change in practices.
Plaintiffs' lawyer Stephen DeNittis says the company should either make their sandwiches 12 inches long or stop advertising them as footlongs.
He said he's measured sandwiches from 17 area shops and not one has been 12 inches long.
Subway did not immediately return a call to The Associated Press.
The issue got widespread attention last week when a man posted a photo of a sandwich and a ruler on the company's Facebook page.
More than 100,000 people have "liked" or commented on the photo, which has the caption "Subway pls respond." Lookalike pictures have popped up elsewhere on Facebook. And The New York Post conducted an investigation that found four out of seven footlong sandwiches were shy of the 12 inches that makes a foot.
Last week Subwaysaid that the length of its sandwiches may vary slightly when its bread, which is baked at each Subway location, is not made to the chain's exact specifications.
"We are reinforcing our policies and procedures in an effort to ensure our offerings are always consistent no matter which Subway restaurant you visit," Subway said in an e-mailed statement.

The parties that are suing, and their attorneys should all be brought up on charges of filing a frivolous lawsuit. What BS........ and what do you want to bet that the two guys from NJ suing Subway really don't NEED to consume another inch of sandwich?Â

Well, if a baker's dozen is thirteen cookies or whatever, why isn't a baker's foot 13 inches?
I always ask myself, "Would the bank forgive your mortgage if you're a penny short?" If "Yes", then I'm willing to throw away an inch for the advertised price. If "No", then I want what I paid for.
Waste of everyone's time and possible court time. If it does go to court, hope for summary judgment that the Plantiff can go to where the "bun" don't shine. The attorney taking the case can do the same.  Lame, Lame, Lame!
Would the jerk still be suing them if the sandwiches measured 12 1/4"? Â Its not the 12' as advertised...better sue. Â Anyway they just say fooltlongs.....they are longer than my foot... Â This guy and his lawyer should be thrown in jail for being A>>>holes.
Are they also going to sue that a 6" sub is not always 6"'s? The counter people only eyeball where to cut the bread. They do not measure it out before cutting.
I don't agree with suing for being too short, most men are, but I have dropped Subway from my list because the sandwich you actually get is NOTHING like what they advertise and what they post the picture as. If they would just sell what they advertise, I would be a customer. Give me a sandwich that even remotely looks like what they advertise and I will be back.

Well that means you probably don't go to any fast food places then because none of it looks like it does on TV.
@rpuffd Have you ever seen the documentary about what it takes to make a commercial that involves food? For instance, for a Big Mac commercial, it takes an "artist" HOURS to build the perfect Big Mac for tv. The bun has to have a certain number of sesame seeds, the cheese has to be perfectly melted (by a heat gun), and even then they STILL airbrush the heck out of it.

The advertising needs to be changed to "large" and "small" from 12" and 6", or go by weight of the bread. That way there will be no argument about inches.

These are not priced by the foot.. It is an advertisement.. Just another couple of fools looking to make a buck and tie up the court system.. Get a life.
I can see the confusion.... most men think that 6" is 10"! ;-) Just a sidenote, that sandwich looks a little janky -- bread all ripped and smooshed.

HELLO? Bread is full of AIR. It's like paying $2 for a 12" balloon then complaining because yours was only blown up to 11". Here's your sign. If you eat a 13" loaf of bread all you're getting is more AIR.
And here's come crazy math: when you cut it in half, no matter what size it was it's still gonna be HALF.
I'm actually behind this one. If their menu states foot longs and 6" subs, that really ought to be what people get. Other sandwich shops handle it differently. Personally our family avoids subway due to the poor customer serevice we've received, the cr@ppy sandwiches, and the reluctance to make a decent sandwich. We were told that if we wanted the pieces of cheese to touch, we'd be paying for double cheese. Not even close to the service we get at other shops like quizzno's, jimmy johns, and jersey mike's. So needless to say, that's where we go when we feel like a hoagie.
I really hope those guys don't win. Â Bread cuts are variable, due to many environmental factors. Â A reasonable person can easily understand this. Â Their case is worthless. Â Personally, if you are going to sue a food processor, sue companies who package food in boxes like cereal. Â The deception is just ridiculous. Â They rely on the weight listings to show that they aren't cheating anyone. Â However, a pound of feathers compared to a pound of pennies is still deceptive, even though they both weigh a pound. Â Okay, rant done...Â
@31F They shouldn't win because it's a stupid lawsuit. The 12" bread isn't cut, it's a whole loaf of bread. Any decent cook knows bread is full of AIR and a loaf of bread is not going to be an exact size when it is baked on a flat tray, not in a pan 12" long. And if it's allowed to rise another 10 minutes it would be 13" but it still contains just as much ingredients and nutrition as 11".Â
These guys need a day job. Put down the video games.

Since reading this story last week, I knew it would happen. In our sue happy society, frivollous garbage like this has become the norm. I hope to God, that this case ends up before a judge that has some common sense ,the case gets thrown out, and these idiots get a little jail time for wasting the court's time and resources.
Wow this sounds as ridiculous as that woman suing the state of Washington because she didn't get PAID enough to care for her own kid.Â

Then I need to sue every hardware store I've ever bought a 2x4 at....Oh wait, I knew perfectly well that a 2x4 isn't exactly 2" x 4".....and never is. Just a FYI, the real size is 1-1/2" x 3-1/2"
