Why aren't police officers pulling over drivers for talking on cell phones?

As of now, in our state, driving while having a cell phone pressed to your ear is a secondary offense. That means police officers or troopers have to catch drivers breaking another law like speeding first to pull the driver over.

If the driver is also talking on the cell phone while committing the primary offense, then officers can ticket drivers for breaking the hands free law as well. A ticket would cost you $101. Texting and driving is against the law in our state. That fine is $124.
