SLUMLORD GETS A NEW ALLY ...AUBURN WATER

Hi love you guys and wanted to give you a story that started unfolding
a couple of weeks ago and came to a head on friday and is really
coming to head today in Auburn.

Next door neighbor "Troy David" moved into the house as a renter about
7 weeks ago. The house is in foreclosure we thought but the crooked
property defaulter /landlord wanted to try to squeeze a few more bucks
out of this very nice rat trap. Mr. David is a great guy and moved
here from Portland Oregon thinking the house he was paying thru the
nose for and didn't know was in foreclosure (the last ugly part of it)
moves up here to a house that was not habitable ...truck full of stuff
and two little girls (3 and 5) and his rental property was a
nightmare. No heat carpets so filthy rats wouldn't walk across them
...no fire detectors..guys this place stunk 3 houses away ...wow! we
all felt bad ...he wrote a letter to the slum lord jeffrey faulkner
asking him to at least get some heat (it was late may) to the house
etc. and faulkner responded by telling him to go **** himself and to
get out of the house...rent had been paid ... Mr David tried 2 or 3
more times to get things so he could live there with the same response
and worse. I heard one screaming phone call made to mr david by a man
saying he was mr faulkners represenative (from a real estate company)
threaten to kick Mr. David's ass if he didn't get out that day. They
came over during the day while he was gone and drilled out the front
door lock and left the house with no door knob or lock and exposed Mr.
david's personal property to theft etc. they walked in and out of the
house while Mr. David was home (or not) without knocking and realtors
did the same to try to show the house (against the law w/ no notice)
Finally Mr. David told them to take care of their end of the deal or
he would file suit against them which the owner responded to last week
by having all of the utilities turned off ...we (the neighbors stopped
power from being turned off) but Gas and water didn't get caught. Mr
David got the gas back on 2 days later but the Water Bureau ...of
Auburn told him we=hen he went down there to do whetever he had to do
to get his water back on ...that they could not and would not turn it
on unless Mr. david paid the owners past due bill of 132.00 ..Mr.
David is no one's fool and told them they had no legal authority to
withhold service to a new tenant for anyone else's bill ...they said
"try us" and refused to turn it on even with a huge deposit because
they claimed that the owner had to give his permission first and he
left explicit instructions not to turn it on etc. Mr. David called the
cops and they came over and he told them he was going to use self help
to re establish his water service which they had no problem with until
he worked it out ...Then the owner tried to obtain access to the house
and Mr. david told him to get a court order then owner returned with a
couple of cops who he told the same thing to and gave them a copy of
the lawsuit he was filing and did file last monday. He had service
right up until friday afternoon when our beloved city ..no doubt
worried about having enough water for the blistering heat this weekend
...turned him back off and cut the meter out of the line so he
couldn't use self help again without putting in a meter jumper. Long
story short there are asshole landlords out there who do things like
this to good people...but the cities role in this bullying is clearly
illegal and runs 100% against the 9th circuits ruling on this exact
issue:

A city is authorized by RCW 35.21.290-.300 to shut off water service
to a property until delinquent charges have been paid. This statutory
authority was modified by O'Neal v. Seattle. In a September 1995
ruling, the Ninth Circuit Court of Appeals decided that a city must
provide water service to new tenants of rental property and cannot
hold them responsible for the water service debts of a former tenant.
O'Neal v. Seattle, 66 F. 3d 1064 (9th Cir.,1995). Instead, the city
should pursue payment from the prior tenant and the landlord.

You guys should do a story on these poor hot thirsty victims of the
city and the crooked landlord and the weather as a human interest side
light to the weather story which will surely lead the news tonight or
tomorow ...great human interest ...great city is the bad guy ...100
degrees and taking a guys water away including his little kids ...new
to the area ...anyway ...he filed the lawsuit and it would be a great
story ...he is totally supported by the neighbors and we are even
trying to find him another house to rent because he is such a good man

Did the landlord haul all of that junk and garbage in there too? Did he pile all of those newspapers in there? It appears that the tenant is a junk and garbage collector, and that's why he's living there to start with.

It seems to me that the man shouldn't have rented the place to start with. If the place was so bad, why did he rent it? He chose to live there, so that tells me he IS someone's fool. Was he looking to make some money in a lawsuit?
